We respect your privacy and are determined to protect your personal data. This notice sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us.
The General Data Protection Regulation (GDPR) (Regulation (EU)2016/679) is a new regulation which replaces the Data Regulation (Directive 95/46/EC). The Regulation aims to harmonise data protection legislation across EU member states, enhancing privacy rights for individuals and providing a strict framework within which commercial organisations can legally operate.

Data controller
Buckley Consulting Limited is the controller and responsible for your personal data (collectively referred to as Buckley Consulting Limited, "we", "us" or "our" in this privacy notice). The information we collect
To carry out our core recruitment activities, we collect information about you which may include: your name, address and post code; private and corporate email address and phone number; financial documentation; references verifying your qualifications and experience and your right to work in the United Kingdom; curriculum vitae; employment details and preferences; links to professional profiles available In the public domain eg LinkedIn, Twitter, Facebook for Business or corporate website.
Special Category Data. You may wish to share sensitive personal data with us which has a relevance to your working life eg health. Occasionally a client asks us for special categories of data as part of their recruitment process. This could include a copy of a passport with biometric identity details for example.
If you fail to provide personal data
You may refuse to provide any of the data we request or withdraw consent for Buckley Consulting Limited to collect and process this information at any time. However, if you feel unable to share certain information with us, that may limit how effectively we can advise you and, depending on what the information is that you wish to withhold, whether we can advise you at all.
How we collect this information
The information we collect about you will be provided by you, either by filling out a form on our website or by corresponding with us by phone, email or otherwise. It will also include information you provide when you register to use our website, subscribe to our services, attend our events, participate in discussion boards or other social media functions on our website, and when you report a problem with our site.
We may also obtain information about you from other sources such as corporate websites, your business card, personal recommendations, and any relevant social media sites. In this case – and within 30 days of collecting – we will inform you that we hold this personal data, the source the data originated from, whether it came from a publicly accessible source, and for what purpose we intend to retain and process your personal data.
Our legal basis for processing data
We will only use your personal data when the law allows us to.
Most commonly, we will use your personal data in the following circumstances:
- Performance of Contract this means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.
- Legitimate Interest this means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the most secure experience. We make sure we consider and balance any potential impact on you and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law).
- Comply with a legal or regulatory obligation this means processing your personal data where it is necessary for compliance with a legal or regulatory obligation that we are subject to.
- Consent occasionally candidates may wish to share sensitive personal data with us for example in relation to health issues which have a relevance to their working life. This comes under Special categories of data. If this is the case, we shall ask for your specific consent for this sensitive data to be collected and processed. Occasionally a client asks us for special categories of data as part of their recruitment process. This could include a copy of a passport for example. If that is the case, we shall contact you and ask for your specific consent for the sensitive data to be collected and processed. Data security
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions, and they are subject to a duty of confidentiality.
All information stored on our recruitment software is secured through the Microsoft Azure Infastructure and located at two data centres within Europe. Our primary centre is located in Microsoft’s Western European centre, and these facilities are secured by a series of measures, including (but not limited to) biometric access, security alarm systems, round-the-clock security staff. Despite the security measures we have in place to protect your personal data, we cannot guarantee that loss, misuse or alteration of your data will not take place.
We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
How long we keep your data for
We retain different types of data for differing periods of time. The criteria we use to determine whether we should retain your personal data and how long for includes:
- The nature of the personal data
- The perceived accuracy of the data
- Your engagement with our services
- Our legal obligations following an offer or when a placement has been made.
We may archive all or part of your personal data or retain it on our financial systems but delete all or part of it from our recruitment software. On removal, we may anonymise parts of your data – particularly following a request for suppression or deletion of your data – to ensure that we do not re-enter your personal data on our database, unless you have requested us to do so.
Because we offer a very personalised service, we have an exceptionally high number of candidates who return to us continually throughout their careers. This is to move roles but also to seek advice on current salary trends, promotion prospects and general career advice. Subsequently, our current retention period for data on candidates who have not been placed, or who are no longer showing any signs of engagement with our website is 4 years.
Your rights
The GDPR provides you with the following rights:
- The right to be informed about the personal data we process on you
- The right of access to the personal data we process on you
- The right to rectification of your personal data
- The right to erasure of your personal data in certain circumstances
- The right to restrict processing of your personal data
- The right to data portability in certain circumstances
- The right to object to the processing of your personal data
- The right not to be subjected to automated decision-making and profiling.
We take the responsibility for the security and accuracy of your personal data very seriously and it is important to us that the data we hold is correct and up to date.
